Abstract

Avec l'invention d'une police rigoureuse et de pratiques rationnelles fondées sur l'administration logique de la preuve, les Tribunaux des Inquisitions ibériques ont contribué à l'émergence de la modernité en Occident. L'action inquisitoriale a pour but l'extirpation des hérésies (à l'origine principalement de l'hérésie judaïsante) et le salut de l'âme des inculpés eux-mêmes, à condition évidemment que ceux-ci se repentent sincèrement de leurs fautes et se confessent exhaustivement. Les archives des Tribunaux de l'Inquisition fournissent, du XVIe au XVIIIe siècle, une abondante documentation qui permet d'analyser les procédures appliquées au rassemblement et au recoupement des preuves de culpabilité (par l'espionnage, le mouchardage et la dénonciation bien plus que la torture), ainsi que les techniques d'investigation et d'interrogatoire qui, au long des procès, finissent par contraindre les accusés aux aveux les plus complets. En bref, la modernité à laquelle contribuent éminemment les Inquisitions n'est autre que celle des systèmes totalitaires qui atteignirent leur plein développement au cours du XXe siècle.

Abstract

From the sixteenth to the eighteenth centuries, the Spanish and Portuguese Inquisitions conducted a number of trials against individuals accused by members of their communities of being of the other gender – men accused of being women and women accused of being men – or even hermaphrodites. Using new inquisitorial sources, this study examines the complexities revolving around transgenderism and the construction of gender identity in the early modern Iberian World. It throws light upon the manner in which the Inquisition, medical practitioners and the wider society in Spain and Portugal responded to transgenderism and on the self-perception of individuals whose behaviour, whether consciously or unconsciously, flouted these social and sexual conventions.
